Theorization on Certain Legal Statements with the Cartesian Plane and Their Practical Effects

Abstract

This study explores the relationship between legal claims and mathematical resources, aiming to identify novel approaches that enhance the understanding of the intersection between Law and Mathematics. The research focuses on how these insights can be applied to improve the development of new studies that offer practical solutions. Employing an analytical, documentary, synthetic, and interpretive methodology, the study adopts a qualitative approach with a deep explanatory focus. This methodology is validated through the examination of patent claims, particularly in relation to the numbering system outlined in the Patent Law of Invention, Utility Models, and Industrial Designs of Nicaragua. The research highlights the importance of correctly classifying claims based on dependency, specifically deeming claims with multiple dependencies as unacceptable. A point graph on the Cartesian plane is used to propose an initial solution for software development to address the non-approval of multiple-dependent claims. Furthermore, the application of zero for independent claims provides a rapid method for determining the number of inventions within a claim, offering a new interpretive reading that moves beyond literal text.
